Article 2 – Applicability

These general terms and conditions apply to every offer from Five Twenty Eight and to every distance contract between Five Twenty Eight and the consumer.

The terms and conditions are made available before or during the ordering process. They can also be downloaded from our website. The terms and conditions can be sent free of charge by e-mail upon request.

If any provisions of these terms and conditions are in conflict with the law, the remaining provisions shall remain in full force and effect and the legally permitted arrangements shall apply.

Article 3 – Product range and prices

• All products on www.five-twentyeight.nl are described clearly and truthfully. Images are as accurate as possible, but small color or detail deviations may occur.

• Prices include VAT and exclude shipping costs. Any shipping costs will be stated separately during checkout.

• Obvious errors or mistakes in the offer do not bind Five Twenty Eight.

• Gift cards are not exchangeable for cash and are non-refundable.

Article 4 – Ordering and payment

• Orders are placed via our webshop and paid for directly using one of the following payment methods: iDeal, Klarna, PayPal or credit card.

• For payments via Klarna, a payment term of 14 days applies, unless otherwise agreed.

• Five Twenty Eight ensures a secure web environment and appropriate measures to secure the payment transaction.

Article 5 – Delivery

• Delivery is only possible within the Benelux.

• Shipping costs are €7.10 per order. For orders over €75,- no shipping costs are charged. If a return shipment brings the total amount below this threshold, the shipping costs will still be charged.

• Orders will be shipped within 1-3 business days after payment via PostNL. In case of delay, the customer will be informed and has the right to cancel the order free of charge.

• Five Twenty Eight bears the risk of damage or loss until the moment of delivery to the customer.

Article 6 – Right of withdrawal and returns

• The consumer has the right to cancel the agreement within 14 days after receipt without giving any reason.

• After notification of withdrawal, the consumer has 14 days to return the product. Return costs are for the account of the consumer.

• Returns will only be accepted if the item is returned undamaged, unworn and in the original packaging.

• The purchase amount will be refunded within 14 days after receipt and inspection of the return via the same payment method.

Article 7 – Exceptions to the right of withdrawal

• Sale items cannot be returned unless the product is damaged upon receipt or has a manufacturing defect.

• Gift vouchers are excluded from revocation and cannot be exchanged for cash.

Article 8 – Warranty and complaints

• Five Twenty Eight carefully checks products before shipping. If a product is damaged upon receipt or has a production deviation, the consumer is entitled to warranty.

• Complaints can be submitted within 14 days after receiving the product via info@five-twentyeight.nl . In case of justified complaints, the product can be returned for replacement or refund.

• Disputes that cannot be resolved amicably can be submitted to an independent dispute committee.

Article 9 – Liability

• Five Twenty Eight is only liable for direct damage resulting from intent or gross negligence.

• The maximum liability is limited to the purchase price of the product concerned.

Article 10 – Privacy Policy

• Five Twenty Eight respects the privacy of its customers. Personal data is only collected for processing orders and communication about them.

• Personal data will not be shared with third parties, except when necessary for the execution of the agreement (e.g. shipping companies or payment providers).

Article 11 – Other provisions

• Dutch law applies to all agreements with Five Twenty Eight.

• Disputes that cannot be resolved amicably will be submitted to the competent court in the Netherlands.
